Case Update: David Faulkner and Jonathan Smith

Fighting to Appeal

Most of us spend the summer enjoying weekend barbeques and extra time with family. David Faulkner and Jonathan Smith have been denied those simple pleasures for 15 years. We had hoped they would have a chance to enjoy them this summer.

In April, we presented to a trial court physical evidence proving their innocence (and someone else’s guilt) and substantial evidence of government misconduct. Sadly, we learned in June that we lost. We are already working to appeal the decision, which was based on a wealth of factual and legal errors, and we hope David and Jonathan will soon be free to enjoy the things we too often take for granted.
